Motion by Joseph Kleinman for leave to appeal to this Court from an order of the Appellate Term, Ninth and Tenth Judicial Districts, dated June 28, 2018, which determined appeals from a judgment of the District Court of Nassau County, First District, dated July 16, 2015, and a decision of the same court dated April 1, 2015, and to consolidate the appeal from the order dated June 28, 2018, with an appeal from an order of the Supreme Court, Kings County, dated February 6, 2017.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,

ORDERED that the motion is otherwise denied as academic.
