DECISION & ORDER ON MOTION

The People of the State of New York, Respondent, v Jermell Blackman, Appellant.

Motion by appellant on an appeal from a judgment of conviction of the District Court of Nassau County, First District, rendered December 12, 2017, to enlarge the record on appeal to include a transcript of the trial proceedings on May 11, 2017.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED, on the court's own motion, that the appeal is stricken from the appeals calendar and the general calendar, as the appeal has not been properly perfected in that a settled transcript of the trial proceedings on May 11, 2017 has not been made part of the record; and it is further,

ORDERED that appellant's motion is denied.

The transcript must be settled in the District Court.
