DECISION & ORDER ON MOTION

Application by the respondents-appellants on an appeal and a cross appeal from an order of the Supreme Court, Suffolk County, dated January 9, 2018, pursuant to 22 NYCRR 1250.9(b) to extend the time to perfect the cross appeal.

Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is

ORDERED that on the Court's own motion, the appeal is dismissed, without costs or disbursements, for failure to timely perfect in accordance with an order on application of this Court dated November 14, 2018; and it is further,

ORDERED that the application is granted, and the time to perfect the cross appeal is extended until February 4, 2019.
