| ORDER TO SHOW CAUSE |
Appeal from an order of the Supreme Court, Richmond County, dated July 29, 2002. By decision and order of this Court dated January 26, 2004, the matter was remitted to the Supreme Court, Richmond County, to hear and report, and the appeal was held in abeyance in the interim. The appellant did not advise this Court that the hearing was conducted nor did this Court receive a report from the Supreme Court.
Now, on Court's own motion, it is
ORDERED that the parties to the appeal are directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal on the ground that the appeal has been abandoned, by filing an affirmation or an affidavit on that issue in the office of the Clerk of this Court on or before January 23, 2019; and it is further,
ORDERED that the Clerk of this Court or her designee is directed to serve a copy of this order to show cause upon the parties to the appeal by regular mail.
