| DECISION & ORDER ON MOTION |
Motion by the defendant on an appeal from a judgment of the Supreme Court, Queens County, entered March 9, 2015, which was determined by decision and order of this Court dated May 24, 2017, inter alia, to recall and vacate an order on application of this Court dated October 15, 2015. Cross motion by the appellant to impose a sanction upon the defendant and his attorney, and for an award of an attorney's fee.
Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is
ORDERED that the motion and the cross motion are denied.
