Motion by the appellant to recall and vacate so much of a decision and order on motion of this Court dated October 29, 2018, as dismissed an appeal from an order of the Family Court, Kings County, dated June 21, 2018, on the ground that the appeal has been rendered academic, to reinstate the appeal, for leave to prosecute the appeal as a poor person, and for the assignment of counsel.
Upon the papers filed in support of the appellant's motion and the papers filed in opposition thereto, it is
ORDERED that the branches of the motion which are to recall and vacate so much of the decision and order on motion dated October 29, 2018, as dismissed the appeal from the order dated June 21, 2018, and to reinstate the appeal are denied; and it is further,
ORDERED that the motion is otherwise denied as academic.
