DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from an order of the Supreme Court, Queens County, entered July 28, 2016, inter alia, in effect, for a reconstruction hearing with respect to certain motion papers and to extend the time to serve and file a reply brief. By decision and order on motion of this Court dated August 8, 2018, that branch of the motion which was, in effect, for a reconstruction hearing was granted, the matter was remitted to the Supreme Court, Queens County, for a reconstruction hearing, and the motion was otherwise held in abeyance in the interim pending receipt of a report from the Supreme Court, Queens County. A report on the reconstruction hearing and certain papers have now been filed with this Court.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, and following the report on the reconstruction hearing, it is

ORDERED that the branch of the motion which is to extend the time to serve and file a reply brief is granted, the appellant's time to serve and file a reply brief is extended until January 25, 2019, and the reply brief shall be served and filed on or before that date; and it is further,

ORDERED that the motion is otherwise denied.
