Motion by the defendant for leave to prosecute an appeal from an order of the County Court, Suffolk County, dated January 2, 2018, as a poor person and for the assignment of counsel.

ORDERED that the motion is denied as academic in light of the decision and order on application of this Court dated January 11, 2019, which denied the defendant's application for leave to appeal to this Court from the order dated January 2, 2018.
