Appeal from an order of the Family Court, Nassau County, dated December 28, 2017. By decision and order on motion of this Court dated October 17, 2018, the respondent's motion to dismiss the appeal was denied on condition that on or before December 17, 2018, the appellant settle and file the transcript of the proceedings. The appellant has failed to file the transcript of the proceedings.
Now, on the Court's own motion, it is
ORDERED that the appeal is dismissed, without costs or disbursements, for failure to comply with the decision and order on motion of this Court dated October 17, 2018.
