Jacob Milton and Frederick Randolph, Respondents, v George Subhraj, et al., Appellants.

Appeal from orders of the Civil Court of the City of New York, Queens County, entered July 31, 2017 and October 20, 2017, respectively. By decision and order on motion of this court dated February 26, 2018, the appeal was held in abeyance pending a substitution for the deceased appellant George Subhraj. This court has now been advised that so much of the action as was against the deceased appellant has been withdrawn.

On the court's own motion, it is

ORDERED that the appeal is restored to the general calendar; and it is further,

ORDERED that appellant is directed to serve and file an appellant's brief within 30 days of the date of this decision and order on motion; and it is further,

ORDERED that respondent, if so advised, may serve and file a respondent's brief within 21 days after the appellant's brief is served and filed pursuant to this decision and order on motion; and it is further,

ORDERED that appellant, if so advised, may serve and file a reply brief within 14 days after the respondent's brief is served and filed pursuant to this decision and order on motion.
