The People of the State of New York, Respondent, v Stephen C. Swett, Appellant.

Motion by appellant for leave to prosecute an appeal from a judgment of conviction of the Justice Court of the Town of Yorktown, Westchester County, rendered July 12, 2018, as a poor person, and for the assignment of counsel.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is denied without prejudice to renewal upon appellant furnishing this court with proper papers.

Appellant has failed to furnish this court with the financial affidavit necessary to determine whether he is indigent.
