| DECISION & ORDER ON MOTION |
Appeal by Amparo Narvaez from an order of the Family Court, Nassau County, dated June 26, 2018. By order to show cause dated December 12, 2018, the parties were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal in the above-entitled proceeding for failure to comply with a decision and order on motion of this Court dated October 24, 2018, issued pursuant to § 670.3(b)(4) of the rules of this Court (22 NYCRR 670.3[b][4]).
Now, upon the order to show cause and the papers filed in response thereto, it is
ORDERED that the motion to dismiss the appeal is denied; and it is further,
ORDERED that the appellant's brief submitted to the Clerk of the Court is accepted for filing and deemed timely served; and it is further,
ORDERED that pursuant to § 670.3(b) of the rules of this Court (22 NYCRR 670.3[b]), the respondent's time to serve and file a brief is extended until March 4, 2019, and the respondent's brief shall be served and filed on or before that date.
