v Deonicio Genao, appellant.

(Ind. No. 2151/12)

DECISION & ORDER ON MOTION

Appeal by Deonicio Genao from an order of the Supreme Court, Queens County, dated January 30, 2018. By order to show cause dated October 24, 2018, the appellant was directed to show cause before this Court why the appeal should not be dismissed on the ground that the order entered January 30, 2018, is neither appealable as of right nor by permission.

Now, upon the order to show cause and no papers having been filed in response thereto, it is

ORDERED that the motion to dismiss the appeal is granted, and the appeal is dismissed (see CPL 450.10, 450.15).

DILLON, J.P., LASALLE, BARROS and CHRISTOPHER, JJ., concur.
