DECISION & ORDER ON MOTION

Motion by New York-Presbyterian Hospital/Columbia University on an appeal and cross appeals from an order of the Supreme Court, Kings County, dated November 22, 2017, in effect, to dismiss the appeal and to extend the time to perfect its cross appeal.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is, in effect, to dismiss the appeal is denied as unnecessary as the appeal has been deemed dismissed pursuant to 22 NYCRR 1250.10(a); and it is further,

ORDERED that the branch of the motion which is to extend the time to perfect the cross appeal of New York-Presbyterian Hospital/Columbia University is denied without prejudice to making a motion pursuant to 22 NYCRR 1250.10(c) to vacate the dismissal of that cross appeal as that cross appeal has been deemed dismissed pursuant to 22 NYCRR 1250.10(a).
