Roug Kang Wang, et al., appellants,

v John Hon, respondent, et al., defendants.

(Index No. 12353/17)

ORDER TO SHOW CAUSE

Appeals by the plaintiffs from an order of the Supreme Court, Queens County, dated August 7, 2018, and the denial of an application to sign an order to show cause on September 7, 2018.

On the Court's own motion, it is

ORDERED that the parties are directed to show cause why the appeal from the order dated August 7, 2018, should or should not be dismissed on the ground that no appeal lies as of right from an order that was not the result of a motion made on notice, and leave to appeal has not been granted (see CPLR 5701), and why the appeal from the denial of an application for an order to show cause on September 7, 2018, should or should not be dismissed on the ground that no appeal lies from the denial of an application for an order to show cause (see Khanal v Sheldon, 74 AD3d 894; Matter of Astoria Gas Turbine Power, LLC v Tax Commn. of City of N.Y., 14 AD3d 553; CPLR 5701), by filing an affirmation or affidavit on those issues with the Clerk of this Court on or before March 7, 2019; and it is further,

ORDERED that the Clerk of this Court, or her designee, shall serve a copy of this order to show cause on the parties to the appeal by regular mail.

SCHEINKMAN, P.J., MASTRO, RIVERA, DILLON and BALKIN, JJ., concur.
