Motion by the respondent, inter alia, to dismiss an appeal from a judgment of the Supreme Court, Queens County, entered September 28, 2017, for failure to comply with a decision and order on motion of this Court dated November 2, 2018.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is to dismiss the appeal for failure to comply with a decision and order on motion of this Court dated November 2, 2018, is granted and the appeal is dismissed, without costs or disbursements; and it is further,
ORDERED that the motion is otherwise denied as academic.
