Respondent having moved for an extension of time to file and serve a brief on this CPLR article 78 proceeding transferred to this Court by an order of the Supreme Court entered in the Office of the Clerk of the County of Wyoming on December 12, 2018, and to put over term,
Now, upon reading and filing the affirmation of Marcus J. Mastracco, Esq., dated February 4, 2019, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted insofar as it seeks an extension of time to file and serve a respondent's brief on the condition that the brief is filed and served on or before April 3, 2019, and the Clerk is directed to accept the brief for filing, and
It is further ORDERED that the proceeding is removed from the Court's day calendar of April 3, 2019, and added to the term of this Court commencing May 13, 2019.
