| DECISION & ORDER ON MOTION |
Motion by the appellant to stay the trial on issues of equitable distribution in the above-entitled action and enforcement of three orders of the Supreme Court, Queens County, all dated November 14, 2018, pending hearing and determination of an appeal from an order of the same court dated September 11, 2018, and to direct the respondent to pay maintenance in accordance with the judgment of divorce dated April 20, 2015, during the period of time that the stay is in effect.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted and the trial in the above-entitled action on issues of equitable distribution and enforcement of three orders dated November 14, 2018, which direct the appointment of appraisers, are stayed pending hearing and determination of the appeal on condition that the appeal is perfected on or before March 29, 2019; and it is further,
ORDERED that in the event the appeal is not perfected on or before March 29, 2019, the Court, on its own motion, may vacate the stay, without further notice, or the respondent may move to vacate the stay, on three days notice; and it is further,
ORDERED that the respondent shall pay maintenance in accordance with the judgment of divorce dated April 20, 2015, during the period of time that the stay is in effect.
