| DECISION & ORDER ON MOTION |
Motion by the appellant to enlarge the record on an appeal from a judgment of the County Court, Dutchess County, rendered June 12, 2018, to include certain material.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the matter is remitted to the County Court, Dutchess County, to report on whether it considered the stenographic transcript, digital recordings, or written records of the City Court of the City of Poughkeepsie, Dutchess County, concerning proceedings which occurred on November 15, 2017, in determining the appellant's motion to controvert the search warrant which resulted in his arrest; the County Court, Dutchess County, shall file its report with all convenient speed; and it is further,
ORDERED that the motion is held in abeyance in the interim.
