| DECISION & ORDER ON MOTION |
Motion by the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts to deem charges against the respondent established based upon default, and to impose such discipline upon him as this Court deems appropriate. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on May 31, 1989, under the name John Gerard Grogan. By decision and order on motion dated April 5, 2018, this Court immediately suspended the respondent from the practice of law upon a finding that he had engaged in professional misconduct immediately threatening the public interest and directed the Grievance Committee to institute and prosecute a disciplinary proceeding in this Court pursuant to 22 NYCRR 1240.8. Subsequently, the Grievance Committee served and filed a notice of petition and verified petition both dated April 20, 2018.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is denied as academic in light of the opinion and order of this Court dated March 13, 2019, granting the motion of the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts to strike the name of Sean Grogan, admitted as John Gerard Grogan, from the roll of attorneys and counselors-at-law, pursuant to Judiciary Law § 90(4)(b), and declaring him to be disbarred, effective August 29, 2018, based on his conviction of a felony, in a related proceeding under Appellate Division Docket No. 2018-12979 (see Matter of Grogan ___ AD3d ___ [March 13, 2019]); and it is further,
ORDERED that on the Court's own motion, the disciplinary proceeding initiated by the Grievance Committee based upon the notice of petition and verified petition both dated April 20, 2018, is discontinued as academic.
