Appeal from a judgment of the Supreme Court, Dutchess County, dated January 31, 2018. By order to show cause dated December 26, 2018, the parties were directed to show cause why an order should or should not be made and entered dismissing the appeal in the above-entitled matter on the ground that it has been rendered academic.
Now, upon the order to show cause and the papers filed in response thereto, it is
ORDERED that the motion to dismiss the appeal is held in abeyance and referred to the panel of Justices hearing the appeal for determination upon the argument or submission thereof.
