Motion by Joseph M. Brettschneider for leave to withdraw as counsel for Sean Wongsing on appeals from two orders of the Supreme Court, Suffolk County, dated May 16, 2018, and June 26, 2018, respectively, and an appeal and a cross appeal from a judgment of the same court entered July 3, 2018, to extend the time to perfect the appeals, and to consolidate the appeals and cross appeal.
Upon the papers filed in support of the motion and no papers having been filed in relation or opposition thereto, it is
ORDERED that the appeals from the orders are deemed dismissed pursuant to 22 NYCRR 1250.10(a); and it is further,
ORDERED that the branch of the motion which is for leave to withdraw as counsel is granted to the extent that Joseph M. Brettschneider is granted leave to withdraw as counsel on the appeal and cross appeal from the judgment, and is otherwise denied as academic; and it is further,
ORDERED that on or before March 29, 2019, Joseph M. Brettschneider shall serve his client by one of the methods specified in CPLR 2103(c), with a copy of this decision and order on motion and shall file proof of such service with the Clerk of this Court; and it is further,
ORDERED that no further proceedings shall be taken against Sean Wongsing, without leave of this Court, until the expiration of 30 days after service upon him of a copy of this decision and order on motion; and it is further,
ORDERED that the branch of the motion which is to extend the time to perfect the appeals is granted to the extent that the time to perfect the appeal from the judgment is extended until May 28, 2019, and that branch of the motion is otherwise denied as academic; and it is further,
ORDERED that the branch of the motion which is to consolidate the appeals and cross appeal is denied as academic.
