Motion by appellant for a stay pending the determination of an appeal from an order of the Civil Court of the City of New York, Kings County, entered August 20, 2018.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED, on the court's own motion, that the appeal is dismissed as untimely, as the order appealed from was served with notice of entry on November 28, 2018 and the notice of appeal was not filed until January 18, 2019 (see CPLR 5513 [a]); and it is further,
ORDERED that appellant's motion is denied as academic.
