Motion by MHA Realty 1, LLC, in effect, to be substituted as the respondent on an appeal from a final judgment of the Civil Court of the City of New York, Queens County, entered December 12, 2014.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motion is denied without prejudice to renewal.
As the motion papers indicate that Jewish Association Serving the Aging is no longer the guardian for Philip Rostoker, the motion must be denied without prejudice to renewal upon a contemporaneous application to substitute Philip Rostoker's new guardian in the place of Jewish Association Serving the Aging.
