In the Matter of Suffolk County Department

of Social Services, on behalf of Ashley

M. (Anonymous), respondent, v Monwell

W. (Anonymous), appellant.

(Docket No. P-4214-18)

DECISION & ORDER ON MOTION

Appeals by Monwell W. from an order of the Family Court, Suffolk County, dated February 28, 2019, and a decision of the same court also dated February 28, 2019.

On the Court's own motion, it is

ORDERED that the appeal from the order is dismissed, without costs or disbursements, as no appeal lies as of right from a nondispositional order in a proceeding pursuant to Family Court Act article 5 (see Family Ct Act § 1112), and leave to appeal has not been granted; and it is further,

ORDERED that on the Court's own motion, the appeal from the decision is dismissed, without costs or disbursements, on the ground that no appeal lies from a decision (see Schicchi v J.A. Green Constr. Co., 100 AD2d 509).

SCHEINKMAN, P.J., MALTESE, CONNOLLY and BRATHWAITE NELSON, JJ., concur.
