| DECISION & ORDER ON MOTION |
Motion by the appellant to enlarge the record on an appeal from a judgment of the County Court, Dutchess County, rendered June 12, 2018, to include certain material. By decision and order on motion of this Court dated February 27, 2019, the matter was remitted to the County Court, Dutchess County, to report on whether it considered the stenographic transcript, digital recordings, or written records of the City Court of the City of Poughkeepsie, Dutchess County, concerning proceedings which occurred on November 15, 2017, in determining the appellant's motion to controvert the search warrant which resulted in his arrest. The County Court, Dutchess County, has filed its report dated March 4, 2019.
Upon the papers filed in support of the motion and the papers filed in relation thereto, and upon the report of the County Court, Dutchess County, dated March 4, 2019, it is
ORDERED that the motion is denied.
