In the Matter of Deborah Lashlee, respondent,

v Samuel Lashlee, appellant.

(Docket Nos. O-6473-13/17R, O-6473-13/18S)

DECISION & ORDER ON MOTION

Appeal by Samuel Lashlee from an order of the Family Court, Dutchess County, dated August 21, 2018. By order to show cause dated February 27, 2019, the parties were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal in the above-entitled proceedings on the ground that no appeal lies as of right from a nondispositional order in proceedings pursuant to Family Court Act article 8.

Now, upon the order to show cause and no papers having been filed in response thereto, it is

ORDERED that the motion to dismiss the appeal is granted, and the appeal is dismissed, without costs or disbursements (see Family Ct Act § 1112).

LEVENTHAL, J.P., LASALLE, BARROS and BRATHWAITE NELSON, JJ., concur.
