| DECISION & ORDER ON MOTION |
Motion by the respondent to dismiss an appeal from a judgment of the Supreme Court, Richmond County, dated July 30, 2018, on the ground that no appeal lies from a judgment entered upon the default of the appealing party.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is held in abeyance and referred to the panel of Justices hearing the appeal for determination upon the argument or submission thereof; and it is further,
ORDERED that on the Court's own motion, the appellant's time to perfect the appeal is extended until June 17, 2019, and the record or appendix on the appeal and the appellant's brief shall be served and filed on or before that date.
