The People of the State of New York, Respondent, v Alejandro Garcia-Ortega, Appellant.

Motion by Janet E. Sabel, counsel assigned to prosecute an appeal from a judgment of conviction of the Criminal Court of the City of New York, Richmond County, rendered March 22, 2017, to dismiss the appeal as abandoned.

Upon the papers filed in support of the motion and the papers filed in response thereto, it is

ORDERED that the motion is denied without prejudice to a motion to be relieved of the assignment upon papers establishing that appellant has abandoned the appeal by failing to respond to correspondence sent to him by assigned counsel.
