DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from a judgment of the County Court, Dutchess County, rendered April 29, 2013, which was determined by decision and order of this Court dated November 21, 2018, to extend the time to file a motion for leave to reargue the appeal. Separate motion by the appellant for leave to reargue the appeal.

Upon the papers filed in support of the motion to extend the time to file a motion for leave to reargue the appeal and the papers filed in opposition and in relation thereto, and upon the papers filed in support of the motion for leave to reargue the appeal and the papers filed in opposition thereto, it is

ORDERED that the motion to extend the time to file a motion for leave to reargue the appeal is denied as unnecessary as the motion for leave to reargue was timely filed; and it is further,

ORDERED that the motion for leave to reargue the appeal is denied .
