An Article 78 proceeding having been transferred to this Court, pursuant to CPLR 7804(g) by an order of the Supreme Court, New York County, entered on or about August 2, 2018, And petitioner, pro se, having moved, by two separate notices of motion to enlarge the record (M-1222), and to vacate the dismissal of the proceeding, pursuant to 22 NYCRR 1250.10(c) and, upon vacatur, to enlarge the time to perfect the transferred proceeding (M-1223), Now, upon reading and filing the papers with respect to the motions, and due deliberation having been had thereon, It is ordered that the motion seeking to enlarge the record is denied (M-1222); the motion seeking vacatur of the dismissal of appeal, pursuant to 22 NYCRR 1250.10(c), is granted to the extent of reinstating this proceeding and enlarging the time in which to perfect to the October 2019 Term (M-1223).
