DECISION & ORDER ON MOTION

Appeal from an order of the Supreme Court, Kings County, dated April 30, 2018. By order to show cause dated March 14, 2019, the appellant was directed to show cause before this Court why the appeal should not be dismissed on the ground that the order dated April 30, 2018, was neither appealable as of right nor by permission.

Now, upon the order to show cause and the papers filed in response thereto, it is

ORDERED that the motion to dismiss the appeal is denied (see Matter of James v Donovan, 130 AD3d 1032).
