| DECISION & ORDER ON MOTION |
2019-00142
Steven Kattan, appellant-respondent,
v Sharon Kattan, respondent-appellant.
(Index No. 50082/09)
Motion by Steven Kattan on an appeal from an order of the Supreme Court, Kings County, dated September 18, 2018, and an appeal from a judgment of the same court dated December 11, 2018, to waive certification of the appellant's appendix pursuant to 22 NYCRR 1250.7(g), to extend the time to perfect the appeals, to waive certification by the court reporter of certain transcripts, and, in effect, to amend so much of a decision and order of this Court dated February 6, 2019, as conditioned a stay upon the perfection of the appeals by March 8, 2019.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to waive certification by the court reporter of certain transcripts is denied without prejudice to making a motion to compel the court reporter to certify the transcripts; and it is further,
ORDERED that the branch of the motion which is, in effect, to amend so much of the decision and order of this Court dated February 6, 2019, as conditioned a stay upon the perfection of the appeals by March 8, 2019, is granted and the decretal paragraphs of the decision and order of this Court dated February 6, 2019, are amended by deleting therefrom the date "March 8, 2019," and substituting therefor the date "July 15, 2019"; and it is further,
ORDERED that the motion is otherwise denied.
MASTRO, J.P., AUSTIN, MILLER and MALTESE, JJ., concur.
