| DECISION & ORDER ON MOTION |
Motion by the appellants to stay enforcement of an order of the Supreme Court, Queens County, filed March 27, 2019, and to stay the respondent from closing or attempting to close on the transfer of title to the subject premises, terminating the subject contract, selling, or taking any steps to sell the subject premises to a third party, or causing the release from escrow of the down payment deposit, pending hearing and determination of an appeal from the order.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted, and enforcement of the order dated March 27, 2019, is stayed and the respondent is stayed from closing or attempting to close on the transfer of title to the subject premises, located at 32-39 95th Street, Jackson Heights, New York 11372, terminating the subject contract, selling, or taking any steps to sell the subject premises to a third party, or causing the release from escrow of the down payment deposit, pending hearing and determination of the appeal on condition that the appeal is perfected on or before June 21, 2019; and it is further,
ORDERED that in the event the appeal is not perfected on or before June 21, 2019, the Court, on its own motion, may vacate the stay, without further notice, or the respondent may move to vacate the stay, on three days notice.
