Motion by the respondent to dismiss an appeal from a judgment of the County Court, Rockland County, rendered June 23, 2005, for failure to prosecute.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is dismissed without prejudice to renew upon proper papers, including proof of service upon the attorney who last appeared for the appellant (see CPL 470.60[2]).
