DECISION & ORDER ON MOTION

Motion by the petitioner-appellant on an appeal from an order of the Family Court, Kings County, dated May 23, 2019, inter alia, to remove the child from the respondent-respondent's care and custody and place the child in the care and custody of the petitioner-appellant pending resolution of a hearing pursuant to Family Court Act § 1027, or pending hearing and determination of the appeal from the order dated May 23, 2019.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to remove the child from the respondent-respondent's care and custody and place the child in the care and custody of the petitioner-appellant is granted, and the child is remanded to the care and custody of the petitioner-appellant pending resolution of the hearing pursuant to Family Court Act § 1027, or pending hearing and determination of the appeal from the order dated May 23, 2019, whichever occurs first; and it is further,

ORDERED that the motion is otherwise denied.
