| DECISION & ORDER ON MOTION |
Motion by the appellant to recall and vacate a decision and order on motion of this Court dated February 14, 2019, which dismissed an appeal from a judgment of the Supreme Court, Queens County, rendered March 12, 2013, on the ground that the appellant had abandoned the appeal, and granted assigned counsel's motion, in effect, to be relieved.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted, the decision and order on motion of this Court dated February 14, 2019, is recalled and vacated, the appeal is reinstated, and the appellant's status as a poor person and the assignment of counsel granted by decision and order on motion of this Court dated March 7, 2014, is continued.
