| DECISION & ORDER ON MOTION |
Motion by the respondent-appellant to stay her eviction from the subject premises pending hearing and determination of an appeal from an order of the Surrogate's Court, Westchester County, dated November 21, 2018. Cross motion by the petitioner-respondent to dismiss the appeal on the ground that no appeal lies from an order denying reargument.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the papers filed in support of the cross motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the cross motion is granted and the appeal is dismissed, without costs or disbursements; and it is further,
ORDERED that the motion is denied as academic.
