ORDERED that the decision and order on application of this Court dated May 21, 2019, is recalled and vacated and the following decision and order on motion is substituted therefor:
Motion by the respondent pursuant to CPL 460.20, for a certificate granting leave to appeal to the Court of Appeals from a decision and order of this Court dated January 23, 2019, which reversed a judgment of the Supreme Court, Queens County, rendered November 23, 2015.
