DECISION & ORDER ON MOTION

2019-73 D CR
The People of the State of New York, Respondent, v Anthony Conti, Appellant.

Motion by appellant, pursuant to CPL 460.50, on an appeal from a judgment of conviction of the Criminal Court of Town of Stanford, Dutchess County, rendered December 19, 2018, for a stay of the execution of the judgment.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted only to the extent of staying the execution of the portion of the sentence that imposed a period of probation, on the condition that within 20 days of the date of this decision and order on motion appellant, in compliance with CPL 460.70 (1), orders transcripts of the electronically recorded proceedings, and the motion is otherwise denied; and it is further,

ORDERED that this stay shall terminate and be of no further effect 120 days from the date of this decision and order on motion unless the appeal shall have been brought to argument or submitted to this court, or unless this court shall have extended this order; and it is further,

ORDERED that appellant shall serve a copy of this order, by mail, on the clerk of the court from which the appeal is taken.
