Friendly Hands Apts. LLC v Friendly Hands Inc., et al.
It is Ordered that the motion of the respondents-appellants is granted on condition that respondents-appellants: (1) perfect their appeal by no later than the November 2019 term the filing deadline for which is September 10, 2019. Respondent's briefs are to be filed on or before October 3, 2019; reply briefs, if any, are to be filed on or before October 11, 2019; (2) cease utilization of the leased space at issue as soup kitchen and/or food distribution center during the pendency of this appeal; (3) continue to pay petitioner-respondent accruing use and occupancy as required in the most recent lease agreement on or before each subsequent rental due date, without prejudice. In the event respondents-appellants fail to comply with the foregoing conditions, petitioner-respondent may move, on five days notice, for an order vacating the stay and dismissing the appeal.
