DECISION & ORDER ON MOTION

Appeal from a judgment of conviction of the Criminal Court of the City of New York, Queens County, rendered August 23, 2011. By decision and order of this court dated June 22, 2015, the appeal was held in abeyance and the matter remitted to the Criminal Court for a hearing and a report. A hearing was held on June 29, 2016 in the Criminal Court and the record has been re-transmitted to this court, but without the required report.
Now, on the court's own motion, it is
ORDERED that this appeal is stricken from this court's appeals calendar and general calendar, and the matter is remitted to the Criminal Court to file a signed report with this court, as directed by the June 22, 2015 decision and order. In the event it is not possible to file a signed report based on the hearing that was held on June 29, 2016, the Criminal Court shall conduct a new hearing and file its report with all convenient speed.
