DECISION & ORDER ON MOTION

Appeal from an order of the Family Court, Kings County, dated April 17, 2019. By order to show cause dated May 22, 2019, the parties were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal on the ground that the appeal from so much of the order as concerns the respondent-appellant's visitation with the subject children had been rendered academic by an order of the Family Court, Kings County, dated April 24, 2019, which directed the return of the children to the respondent-appellant's care and custody, and on the further ground that the respondent-appellant is not aggreived by the remaining provisions of the order dated April 17, 2019.

Now, upon the order to show cause and the papers filed in response thereto, it is

ORDERED that the motion to dismiss the appeal is granted, and the appeal is dismissed, without costs or disbursements (see CPLR 5511).
