DECISION & ORDER ON MOTION

Motion by the appellant pro se to be provided with the minutes of his arraignment and the grand jury proceedings to aid in the preparation of his supplemental brief on an appeal from a judgment of the County Court, Suffolk County, rendered September 23, 2016, and to extend the time to serve and file the pro se supplemental brief.

Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is

ORDERED that the branch of the motion which is to be provided with the minutes of the appellant's arraignment is denied without prejudice to renew upon proper papers specifying the issue to be raised in connection with the arraignment minutes; and it is further,

ORDERED that the branch of the motion which is to be provided with the minutes of the grand jury proceedings is granted to the extent that the respondent shall file a transcript of the grand jury proceedings, under seal, with the Clerk of this Court, for in camera review by the panel of Justices assigned to hear the appeal, and that transcript shall remain sealed upon delivery, and that branch of the motion is otherwise denied; and it is further,

ORDERED that the branch of the motion which is to extend the time to serve and file the pro se supplemental brief is granted, and the appellant's supplemental brief shall be served and filed on or before September 13, 2019; and it is further,

ORDERED that the appellant shall file an original and five hard copies of the supplemental brief and serve one copy on the District Attorney.
