| DECISION & ORDER ON MOTION FOR REINSTATEMENT |
Renewed motion by Yehuda David Taller for reinstatement to the Bar as an attorney and counselor-at-law. Mr. Taller was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on June 25, 1997. By decision and order on motion of this Court dated March 31, 2016, the Court authorized the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts to institute and prosecute a disciplinary proceeding against Mr. Taller, and the issues raised were referred to the Honorable Abraham G. Gerges, as Special Referee, to hear and report. By opinion and order dated June 21, 2017, this Court granted the Grievance Committee's unopposed motion to confirm the Special Referee's report and suspended Mr. Taller from the practice of law for a period of one year, commencing July 21, 2017 (see Matter of Taller, 152 AD3d 84). By decision and order on motion dated December 18, 2017, this Court, inter alia, granted Mr. Taller leave to file responsive papers to the motion to confirm the Special Referee's report, and, upon consideration of those papers, adhered to its original determination in the opinion and order dated June 21, 2017. By decision and order on motion of this Court dated January 31, 2019, Mr. Taller's first motion for reinstatement was denied without prejudice to renew upon submission of proper papers.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is held in abeyance and the matter is referred to the Committee on Character and Fitness to investigate and report on Yehuda David Taller's character and fitness to practice law.
