| DECISION & ORDER ON MOTION |
Motion by the Grievance Committee for the Ninth Judicial District, in effect, to amend a decision and order on motion of this Court dated July 9, 2018, which immediately suspended Michael R. Varble from the practice of law pursuant to 22 NYCRR 1240.9(a)(3) and (5). Application by the Grievance Committee for the Ninth Judicial District, pursuant to 22 NYCRR 1240.21, to appoint an attorney to take custody of, and inventory, the legal files of Mr. Varble. Mr. Varble was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the First Judicial Department on January 13, 1997. By opinion and order of this Court dated February 27, 2019, Mr. Varble was disbarred, effective immediately (see Matter of Varble, 170 AD3d 41).
Upon the papers filed in support of the motion and the application, and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that the application is granted; and it is further,
ORDERED that pursuant to to 22 NYCRR 1240.21(a), Rebecca Mayfield Blahut, c/o McCabe & Mack, LLP, 63 Washington Street, Poughkeepsie, N.Y. 12601, is hereby appointed as inventory attorney (1) to take custody of and inventory the files of Michael R. Varble, including any original wills, (2) to take custody of and safeguard the records of any business, escrow, trust, or special bank account of Mr. Varble, (3) to receive, open, and read mail addressed to Mr. Varble at his regular place of business, and (4) to take such action as is deemed proper and advisable to protect the interests of the clients of Mr. Varble.
