| DECISION & ORDER ON MOTION |
Motion by the appellant for leave to serve and file a supplemental brief raising an issue regarding People v Towns (33 NY3d 326), on an appeal from a judgment of the County Court, Suffolk County, rendered May 11, 2017.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted, and on or before August 23, 2019, the appellant shall serve and file the supplemental brief raising an issue regarding People v Towns (33 NY3d 326); and it is further,
ORDERED that the respondent shall serve and file a response to the supplemental brief, if any, on or before September 23, 2019.
