Motion by the appellant pursuant to 22 NYCRR 1250.10(c) to vacate dismissal of an appeal from an order of the Supreme Court, Nassau County, entered October 27, 2016, which was deemed dismissed pursuant to 22 NYCRR 1250.10(a), and in effect, to consolidate that appeal with an appeal from an order of the same court entered January 25, 2019.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to vacate dismissal of the appeal from the order entered October 27, 2016, is denied; and it is further,
ORDERED that the motion is otherwise denied as academic.
