Respondent-appellant having moved to vacate the dismissal of the appeal taken herein from an order of the Family Court, Erie County, entered April 10, 2018 (denominated a motion for an extension of time to serve and file a responding brief), and petitioner-respondent having cross-moved to vacate the order of this Court entered March 26, 2019, which granted respondent-appellant's motion for permission to appeal as a poor person and the assignment of counsel,
Now, upon reading and filing the papers with respect to the motion and cross motion, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted on the condition that the appeal is perfected on or before August 16, 2019, and
It is further ORDERED that the cross motion is denied.
