DECISION & ORDER ON MOTION

Motion by the respondent for leave to reargue an appeal from a sentence of the Supreme Court, Kings County, imposed March 15, 2017, which was determined by decision and order of this Court dated May 29, 2019.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is granted to the extent that the decision and order of this Court dated May 29, 2019 (172 AD3d 1407), in the above-entitled matter, is amended by deleting from the third paragraph thereof the words "Contrary to the People's contention, the" and substituting therefor the word "The," and the motion is otherwise denied.
